Terms of Service

The ground rules that keep every flight — and every project — smooth.

Effective date: August 1, 2026

These Terms of Service ("Terms") govern your use of AboveTheStory.com (the "Site") and your engagement of Above the Story ("we," "us," or "our"), based in Beverly Hills, California, for drone videography services (the "Services"). By using the Site or booking the Services, you agree to these Terms.

Quotes, Pricing & Payment

  • All prices displayed on the Site are current rates only and may change at any time without notice. A price becomes binding only when we confirm your booking in writing.
  • Quotes are estimates based on the information you provide; material changes to scope, location, or timing may change the price.
  • Payment terms (including any deposit) are stated in your booking confirmation. Booked dates may be released if agreed payments are not received.

Service Area & Travel

We are based in Beverly Hills, California, and primarily serve the greater Los Angeles area. Projects outside that area are accepted at our sole discretion and are subject to a travel fee, quoted in advance. We may decline any project, for any location, at our discretion.

Weather, Airspace & Safety

  • Drone operations depend on weather, airspace authorization, and site conditions. We may delay, modify, or reschedule any flight when, in our sole judgment, conditions are not safe or lawful. Rescheduling for weather or airspace reasons is not a breach of these Terms.
  • All flights are conducted in accordance with applicable FAA regulations. We will not perform flights that we determine to be unlawful or unsafe, and no refund obligation arises from our refusal to do so beyond amounts paid for Services not rendered.
  • You are responsible for obtaining permission for filming at locations you select, including private property, HOA, venue, or event permissions. You agree to indemnify and hold us harmless from claims arising out of missing permissions for locations you arrange.

Deliverables & Timelines

  • Delivery timelines shown on the Site (for example, 14-day or 10-day delivery) are good-faith targets, not guarantees. Complex edits, weather reshoots, and factors outside our control may extend delivery.
  • Deliverables are provided through a private online gallery. You are responsible for downloading and backing up your files; we are not obligated to retain project files after delivery.
  • Revision rounds, where included, cover reasonable adjustments to the delivered edit — not a re-shoot or a new concept.

Intellectual Property

  • We retain all copyright and other intellectual property rights in the footage, photographs, and edited films we create.
  • Upon full payment, you receive a broad, non-exclusive, perpetual license to use your delivered files for personal and business purposes, including marketing and social media.
  • We may use project footage, photographs, and films in our portfolio, on social media, and in promotional materials, unless we agree otherwise in writing before the shoot.
  • The Site and its content — including our name, logo, films, images, and text — are our property and may not be copied, scraped, or reused without our written permission.

Disclaimers

THE SITE AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PARTICULAR SHOT, ANGLE, LOCATION, WEATHER CONDITION, OR CREATIVE OUTCOME CAN OR WILL BE ACHIEVED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including weather, airspace restrictions, government action, equipment failure, illness, or other unforeseen circumstances. In such cases we will work with you in good faith to reschedule.

Cancellations & Rescheduling

Client cancellation and rescheduling terms are stated in your booking confirmation. Weather-related rescheduling by us is offered at no charge.

Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising out of these Terms or the Services shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new effective date. Continued use of the Site or booking of Services after changes constitutes acceptance of the updated Terms.
